Feastly · 锋味十足
Terms of Service
These terms are the agreement between you and us for using Feastly (锋味十足, app ID com.feastly.app). They also serve as the end-user licence agreement (EULA) for the app. By downloading, installing or using Feastly you accept them. If you do not accept them, do not use the app.
1. Who these terms are with
These terms form a binding agreement between you and the operator of Feastly (锋味十足) — "we", "us", "our". You can reach us at any time at [email protected]; that one address covers support, billing, privacy and legal notices.
Feastly is distributed through the App Store, but this agreement is concluded between you and us alone. Apple is not a party to it. Section 18 sets out the specific terms Apple requires us to include.
Two further documents form part of your relationship with us and should be read alongside these terms: the Privacy Policy and the Subscription Terms. Where the Subscription Terms address purchases specifically, they prevail over these terms on that subject.
2. What Feastly does
Feastly turns "what is in my fridge" into "what the household eats tonight". The core loop is:
- you photograph your fridge or the market, or simply describe what you feel like;
- an AI model identifies the ingredients, flagging anything it is unsure about for you to confirm;
- the app generates a household-sized menu — several dishes plus a soup — together with a chef's timeline that sequences the cooking so everything reaches the table hot at the same time;
- a grocery list is derived from the menu, de-duplicated across dishes, with what you already have pre-ticked;
- a follow-along cooking mode walks you through the steps with per-step timers and keeps the screen awake.
Menus are scaled to your household composition and adjusted for your stated cuisine preferences and dietary restrictions. Features described as "coming soon" in the app are not yet available and are not part of what we currently provide.
3. Who may use it
You must be old enough to form a binding contract in your jurisdiction. The app is not directed to, and must not be used independently by, children under 13 (under 14 in mainland China). Cooking involves open flame, sharp knives and high temperatures — an adult must carry out the cooking.
If you are a minor above the minimum age, you may use the app only with the consent and under the supervision of a parent or guardian, who accepts these terms on your behalf. Minors must not make in-app purchases without a guardian's consent.
4. Accounts
4.1 Guest and registered accounts
You can start using Feastly immediately as a guest, with no registration. A guest account is anchored to a random identifier the app stores in your device's secure store; that is how your data is found again, including after a reinstall. You may later upgrade to a registered account by setting a username and password, which lets you sign in on other devices.
4.2 Your responsibilities
- Keep your credentials confidential. Activity under your account is your responsibility.
- An account is personal to you. Do not share, sell, rent or transfer it.
- Do not create accounts by automated means, and do not create multiple accounts to obtain benefits intended to be granted once (for example new-user credits).
- Notify us at [email protected] if you believe your account has been compromised.
4.3 Losing a guest account
A guest account depends on the identifier held in your device's secure store. If that store is cleared — for example by erasing the device, restoring it in a way that does not preserve the keychain, or moving to a new device — the guest account and everything in it becomes unreachable, and we have no way to recover it. If your data matters to you, upgrade to a registered account.
5. Your content
"Your content" means what you put into the app: photos, free-text descriptions, preferences, and the menus and lists you save.
- You keep ownership. We claim no ownership of your content.
- You grant us a limited licence. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit and process your content solely to operate and provide the service to you — including passing the necessary parts to third-party AI service providers to perform recognition and generation, as described in the Privacy Policy. This licence exists only for as long as we need it to provide the service, and ends when you delete the content or your account.
- We do not use your content to train models. Neither we nor, under our agreements, our AI providers use your photos or text to train models.
- You are responsible for what you upload. You confirm you have the right to upload it and that doing so does not infringe anyone's rights. Do not upload photos of other people without their consent, photos of private spaces you have no right to photograph, or anything unlawful.
6. Acceptable use
You agree not to:
- use the app for anything unlawful, or to produce content that is unlawful, hateful, harassing or otherwise harmful;
- upload content that infringes intellectual property, privacy or publicity rights;
- attempt to circumvent billing, credit deduction, entitlement checks or usage limits, or obtain paid features without paying;
- reverse engineer, decompile or disassemble the app, or attempt to extract source code, model prompts or credentials, except to the extent this restriction is prohibited by applicable law;
- access the service by automated means (scraping, bots, scripted clients), or generate volume that is abnormal for individual household use;
- probe, scan, overload or interfere with the service or its infrastructure, or attempt to gain unauthorised access to any part of it;
- resell, sublicense or commercially redistribute the service or its output as a competing product;
- misrepresent AI-generated menus as professional nutritional, medical or food-safety advice when passing them on to others.
We may suspend or terminate access that breaches this section — see section 16.
7. AI-generated content
Ingredient recognition and menu generation are performed by AI models. You should understand what that means in practice:
- Recognition can be wrong. The model may miss an ingredient, invent one, or misidentify it. This is why low-confidence items are flagged for you to confirm — please actually check them.
- Menus, quantities and timings are suggestions. The chef's timeline is an estimate of sequencing and heat, not a guarantee. Real cooking times vary with your equipment, your ingredients and you.
- Output is not deterministic. The same photo and the same settings can produce different menus. "Shuffle" deliberately re-rolls the result.
- It is not professional advice. Nothing generated by the app is nutritional, dietary, medical or food-safety advice, and it is not a substitute for a doctor, a registered dietitian or a food-safety authority.
- Generated text and recipes may resemble existing works. We make no representation that generated output is original or free of third-party rights. If you intend to publish or commercially use generated content, satisfy yourself of its status first.
8. Food safety and cooking risk
The dietary restrictions you set are applied as a best-effort constraint on AI generation. They are not an allergy safety guarantee. A generated menu may contain, or fail to flag, an allergen — including allergens hidden in sauces, stocks, condiments or pre-made products. If you or anyone you cook for has a serious food allergy or intolerance, you must independently verify every ingredient and read every product label yourself. Do not rely on this app for allergy safety.
You are also solely responsible for:
- Ingredient condition. We cannot tell from a photo whether food is fresh, correctly stored, within date, or safe to eat. Judge that yourself and discard anything questionable.
- Cooking safety. Cooking temperatures and times sufficient to make food safe (particularly for meat, poultry, eggs, seafood and reheated dishes), safe handling of raw and cooked food, and avoiding cross-contamination.
- Physical risk. Open flame, hot oil, sharp knives, hot cookware and electrical appliances. Adults only, and follow your appliance manufacturers' instructions.
- Household needs. The child and elder adjustments (halved portions with reduced spice; less salt and oil) are simple, fixed heuristics based on the counts you enter — they are not a nutritional prescription and take no account of any individual's medical condition, medication or specific dietary requirements.
9. Credits, purchases and subscriptions
Some features consume credits. You obtain credits by purchasing an auto-renewing subscription or a one-off credit pack through the App Store. Credits are a licence to use features of the service; they are not money, not a stored-value instrument, and cannot be exchanged for cash, transferred between accounts or refunded outside the App Store refund process.
If you run out of credits mid-flow, the app takes you to the purchase screen rather than failing — nothing is lost. All prices are shown in your local currency by the App Store at the point of purchase.
Full purchase, renewal, cancellation and refund terms are in the Subscription Terms, which form part of this agreement.
10. Intellectual property
The app, its interface, the "Feastly" and "锋味十足" names and logos, and all underlying software and content we provide, are owned by us or our licensors and protected by intellectual property law. Subject to these terms, we grant you a personal, non-transferable, non-exclusive, revocable licence to install and use the app on devices you own or control, for your own non-commercial household use. This licence grants you no other rights: you get no right to copy, modify, distribute, sublicense, or create derivative works of the app.
Menus and lists generated for you from your inputs are yours to use for your own cooking, subject to section 7.
11. Third-party services
The app relies on third parties, including Apple (distribution, in-app purchase, subscription management), third-party AI service providers (recognition and generation) and cloud infrastructure providers (hosting and storage). Your use of the app is also subject to those parties' own terms where they apply to you — notably the Apple Media Services Terms and Conditions for anything you purchase. We are not responsible for third-party services we do not control, and their unavailability may make parts of the app unavailable.
12. Availability and changes
- No uptime guarantee. We aim to keep the service available but do not guarantee uninterrupted or error-free operation. Maintenance windows and outages happen; the app will tell you when it is in maintenance.
- Remote feature control. Individual features (for example purchase, generation or recognition) can be disabled remotely — for incident response, to comply with law, or while a defect is fixed. When that happens the affected entry point is hidden or disabled and the rest of the app keeps working.
- Product changes. We may add, change, suspend or withdraw features. We will not make a material adverse change to a paid feature you have already bought without either providing a substantially equivalent replacement or telling you how to obtain a remedy.
- Changes to these terms. We may update these terms. For material changes we will give notice in the app before they take effect, and where the law requires it, obtain your agreement. If you do not accept the updated terms, stop using the app and delete your account.
13. Disclaimers
To the maximum extent permitted by applicable law, the app and the service are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or quiet enjoyment.
Without limiting the above, we do not warrant that ingredient recognition will be accurate, that generated menus will be suitable, palatable, nutritionally adequate or free of allergens, that timings will be correct, or that the service will be uninterrupted, secure or error-free.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these terms excludes or limits rights you have as a consumer under mandatory law.
14. Limitation of liability
To the maximum extent permitted by applicable law:
- we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost goodwill or business interruption, however caused and on any theory of liability;
- our total aggregate liability arising out of or relating to the app or these terms is limited to the greater of (a) the total amount you paid us for the app in the twelve months before the event giving rise to the claim, and (b) the equivalent of ten US dollars.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any third-party claim, loss or expense (including reasonable legal fees) arising out of your content, your use of the app in breach of these terms, or your violation of any law or third-party right. This does not apply where the claim arises from our own breach or negligence.
16. Term and termination
You may stop at any time. You may request deletion of your account — through the account settings in the app, or by emailing [email protected] — or simply uninstall the app. Deleting your account is irreversible and does not by itself cancel an App Store subscription — cancel that separately in your Apple account settings. See the Privacy Policy and the Subscription Terms.
We may suspend or terminate your access if you materially breach these terms (in particular section 6), if required by law, or to protect the service or other users from harm. Where circumstances allow we will give you notice and, for a curable breach, an opportunity to fix it. If we terminate your account without cause, or you terminate because of our material breach, we will refund the unused portion of any prepaid subscription period to the extent the law requires and the App Store refund process allows.
Sections 5 (licence, for content already processed), 7, 8, 10, 13, 14, 15, 17 and 19 survive termination.
17. Governing law and disputes
If you are a consumer, these terms are governed by the law of the country or region where you habitually reside, and you may bring proceedings in the courts of that country or region. Nothing in these terms deprives you of the protection of mandatory consumer-law provisions that apply to you there.
Before starting formal proceedings, please contact us at [email protected] — we will try in good faith to resolve the matter within 30 days.
18. Apple-specific terms
The following apply to the App Store version of the app, and Apple requires them to be stated:
- Parties. This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence in section 10 is limited to a non-transferable licence to use the app on any Apple-branded product you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions, except that it may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law Apple has no other warranty obligation whatsoever with respect to the app.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms when using the app.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- Contact. Questions, complaints and support requests about the app should be directed to [email protected].
19. General
- Entire agreement. These terms, the Privacy Policy and the Subscription Terms are the entire agreement between us about the app and supersede any prior understandings.
- Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or transfer of assets, provided your rights are not diminished.
- Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control.
- Language. This page contains an English and a Chinese version. If there is any inconsistency, the version in the language in which you concluded the agreement prevails; where that is unclear, the English version prevails, except where mandatory local law provides otherwise.
