Terms of Service
These Terms of Service ("Terms") govern your use of Nova (the "App"), an AI-powered image and video generation studio, operated by Linyi Xiaohai Network Technology Co., Ltd. ("Nova", "we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use the App. If you use the App on behalf of an organization, you represent that you are authorized to bind it to these Terms.
2. Your Account
The App creates an anonymous guest account on first launch so you can start immediately. You are responsible for activity that occurs through your account and device. Keep your device secure; we are not liable for loss arising from unauthorized use of your device.
3. License to Use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own lawful use, as permitted by the App's features and the applicable app-store rules.
4. Credits, Virtual Items & Purchases
- The App uses credits to perform tasks. Credits and other virtual items have no monetary value, are not redeemable for cash, and are non-transferable except as expressly allowed in the App.
- Credits are consumed when you submit tasks; consumed credits are non-refundable except as required by law or the app-store rules.
- Subscriptions (e.g., Nova PRO) are governed by our Subscription Terms. Purchases are processed by Apple and subject to Apple's terms.
5. Acceptable Use
You agree not to use the App, including its AI features, to create, upload, or distribute content that:
- is illegal, infringes intellectual-property or privacy rights, or violates any law or regulation;
- depicts or sexualizes minors, or is otherwise child-sexual-abuse material;
- is hateful, harassing, defamatory, or incites violence;
- impersonates a real person or creates deceptive "deepfakes" without consent, or is used for fraud, scams, or misinformation;
- contains malware, or attempts to disrupt, reverse-engineer, scrape, or circumvent the App's security, rate limits, or access controls.
We may remove content and suspend or terminate access for violations.
6. Your Content & Generated Output
- Your inputs. You retain rights to the prompts and reference media you submit, and you represent that you have the necessary rights to submit them. You are solely responsible for your inputs.
- Generated output. As between you and Nova, and to the maximum extent permitted by applicable law and third-party model terms, you own the content you generate and are responsible for its use. You grant us a limited license to host, process, and display output as necessary to operate the service.
- No guarantee. AI output may be inaccurate, may not be unique, and may resemble content created by others. You are responsible for reviewing output before relying on or publishing it.
7. Intellectual Property
The App, its software, design, trademarks, and content (excluding your inputs and your generated output) are owned by Nova or its licensors and are protected by law. These Terms do not grant you any rights in our trademarks or branding.
8. Third-Party Services
The App relies on third-party services (including Apple and AI model providers). Your use of those services may be subject to their own terms. We are not responsible for third-party services.
9. Disclaimers
THE APP AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Linyi Xiaohai Network Technology Co., Ltd. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 50, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold Nova harmless from claims, damages, and expenses arising out of your inputs, your generated output, your use of the App, or your violation of these Terms or applicable law.
12. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the service or other users. Provisions that by their nature should survive termination will survive.
13. Governing Law
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
14. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the App after changes take effect constitutes acceptance.
